New legislation for drainage systems.
On 7 January 2019, new legislation came into effect requiring Sustainable Drainage Systems (SuDS) for surface water for all new developments of more than 1 dwelling house or where the construction area is 100m2 or more. SuDS on new developments must be designed and built in accordance with the Statutory SuDS Standards published by Welsh Ministers and SuDS Schemes must be approved by the local authority acting in its SAB role, before construction work begins. The legislation is covered by Schedule 3 to the Flood and Water Management Act 2010 (external link) which makes SuDS a mandatory requirement for all new developments.
Welsh Government has stated that making SuDS mandatory on new developments will help deliver its commitment to improve management of the water environment. It also supports targets for new developments while delivering ecosystem resilience, enhanced biodiversity and benefits for citizens across Well-being Goals and Prosperity for priorities.
